Terms of Use for Access to NFLIS Data
Parties:
This Terms of Use (“Agreement”) is entered into between the Drug Enforcement Administration (DEA) and the Authorized User (“User”) granted access to the DEA’s National Forensic Laboratory Information System (NFLIS).
1 Purpose
1.1 The terms outlined herein govern the access and use of the National Forensic Laboratory Information System (NFLIS) data provided by the Drug Enforcement Administration (DEA). The purpose of these terms is to ensure that data is used responsibly, securely, and in compliance with all applicable legal and regulatory requirements.
2 Definitions
2.1 NFLIS Data: All information, reports, and datasets provided through the NFLIS platform, including but not limited to controlled substance analysis results, aggregated statistics, and related metadata.
2.2 Authorized User: An individual granted login credentials by DEA for legitimate professional use.
2.3 Authorized Purpose: Any access of the NFLIS platform and data must be done responsibly, securely, and in compliance with all applicable legal and regulatory requirements; and in accordance with the restrictions detailed in subsection 5.
3 Access and Use
3.1 Access is granted solely for authorized purposes consistent with the User’s role and responsibilities.
3.2 The User shall not share login credentials or permit unauthorized access.
4 Data Security and Confidentiality
4.1 The User must implement appropriate technical, physical, and administrative safeguards to protect the NFLIS data from unauthorized access, disclosure, alteration, or destruction.
4.2 Any suspected breach or unauthorized disclosure must be reported immediately to DEA.
5 Restrictions
5.1 The User agrees not to:
5.1.1 Use NFLIS data for any commercial purposes or financial gain.
5.1.2 Share NFLIS data with unauthorized third parties.
6 Compliance
6.1 The User agrees to comply with all applicable federal laws, DEA policies, and privacy regulations.
6.2 Non-compliance may result in termination of access and potential legal action.
7 Audit and Monitoring
7.1 DEA reserves the right to monitor User activity and audit data usage to ensure compliance.
8 Termination
8.1 DEA may revoke access at any time at DEA’s discretion.
8.2 DEA may terminate access for violation of any enumerated terms.
8.3 Termination of access does not relieve the User of their obligations under these Terms of Use.
9 Acknowledgement
9.1 By accessing NFLIS data, the User acknowledges and agrees to abide by these Terms of Use.
10 Indemnification
10.1 The User agrees to indemnify and hold harmless the DEA from any claims, damages, liabilities, or expenses arising from the User's violation of these terms, use, or misuse of NFLIS data.
11 Limitation of Liability
11.1 Under no circumstances shall the DEA be liable for any indirect, incidental, special, or consequential damages resulting from the Authorized User’s access to, use, or misuse of NFLIS data.
12 Amendments
12.1 DEA reserves the right to amend these Terms of Use at any time.
